Pedestrian struck by delivery truck in marked crosswalk-$1.9 million settlement
In February 2017, a women was in a crosswalk walking across a street in Old Town Alexandria. At the same time, a delivery truck driver was approaching the intersection, intending to turn right onto the street the person was crossing. As the driver was making the turn, he failed to see the woman and struck her, knocking her to the ground. Unaware of the accident, the driver continued moving forward, wedging the women between the front tire and pavement until an eyewitness alerted the driver to stop.
A lawsuit was filed against both the driver and his corporate employer. The driver was initially found not guilty of reckless driving at a traffic trial. However during discovery for the preceding lawsuit, a dash cam video showed that the person was clearly in the crosswalk when the driver approached the intersection. The person’s pelvic fractures resolved with surgery, but the internal injuries required multiple surgeries and debridements (a medical procedure used to remove dead, damaged, or infected tissue from a wound to promote healing and reduce the risk of infection). Permanent injuries include surgical scarring and a lack of contour on the person’s upper leg. The case ultimately settled for $1.9 million and was an effort of the entire Curcio Law team to include attorneys Thomas Curcio, Justin Curcio, and Rakin Hamad.
Plaintiff’s scalp burned during high-lightening treatment at salon — $300,000 settlement
A 33-year-old woman went to a hair salon for a hair-lightening treatment. The stylist applied a hair-lightening chemical to her head and covered it with aluminum foil. Within 10-15 minutes, she experienced pain in the back of her head and noticed her head becoming very hot. An assistant opened the foil and found smoke coming from her head. The stylists immediately rinsed the product out.
After leaving the salon, the area where the product was applied began to swell. Within a week, it started to scab over. She consulted a dermatologist who removed the scab and found that the hair in that area was no longer attached to the scalp. Over subsequent visits, the dermatologist determined that the burn site had turned into scar tissue, resulting in nerve pain and permanent baldness. The dermatologist recommended monthly checkups for the rest of her life due to an increased risk of skin cancer on the scar tissue.
The case settled for $300,000 before a formal lawsuit was filed.
Cars collide on interstate, causing lower back fracture – $125,000 settlement
In August 2021, a car on I-95 attempted to change lanes and collided with another vehicle. The impact pushed the second vehicle into the jersey wall. After hitting the wall, the vehicle crossed all four southbound lanes of Interstate 95 and crashed into the guardrail on the right shoulder. A 57-year-old female passenger in the struck vehicle was taken to the hospital from the scene and diagnosed with a lower back fracture.
Ultimately, the case settled for $125,000, which was the maximum coverage available to the injured party.
Retired nurse fractured foot in interstate accident- $125,000 settlement
A 69-year-old retired nurse was traveling westbound on Interstate 66 in Fairfax County when she began to slow her vehicle due to traffic in front of her. Another driver, who was uninsured, was traveling behind her and failed to slow down, crashing into the rear of her vehicle. The force of the impact pushed her vehicle into the one in front of her, jamming her right foot into the brake pedal.
She was diagnosed with closed displaced fractures of the third and fourth metatarsals, and her orthopedic surgeon recommended an open reduction internal fixation of these bones. She recovered well from the surgery and reached medical maximum improvement in roughly four months.
After pre-suit negotiations with the uninsured motorist carrier, the case settled for $125,000.
Distracted Driver Hits Pedestrian: $100,000 Settlement Secured
A 73-year-old woman was taking photos of a cherry blossom tree on a median along Belle View Boulevard in Fairfax County when she was struck by a car. The driver, who was behind the wheel of a 2016 Toyota Highlander, was distracted and looking at his phone when he lost control of the vehicle and hit her. Police body cam footage revealed the driver admitting that he was using his phone while driving, which is against Virginia law.
As a result of the collision, the woman sustained serious injuries, including a fracture in her lower back. She needed immediate medical care and ongoing treatment from an orthopedic surgeon, with a recovery time of 3 to 6 months. The case settled for the maximum policy limit of $100,000.
