The case centers around an incident where the plaintiff, who was stopped at a red light, became the victim of a rear-end collision in Prince William County. What sets this case apart are the plaintiff’s pre-existing lower back injuries, which had led to the implantation of an implantable pulse generator (IPG) in her back five years prior to this collision. This rechargeable battery-operated spinal cord stimulator (SCS) was intended to alleviate her pain.After the accident, the plaintiff felt pain near her implant site, which continued to affect her for more than a year. Aside from her body’s uncertainty to power the IPG like before the incident, the plaintiff undertook a complicated SCS IPG correction surgery, changing the implant location to minimize her pain.
Central to the case was the question of whether the charging issues stemmed from the collision or been caused by the IPG getting close to the end of its operational life. While the formal lifespan of IPG’s was nine years, the plaintiff’s IPG needed replacement just after six years.
